Welcome to PREBETONE, a sports prediction platform operated by Xenoteb sh.p.k, a company registered and operating under the laws of the Republic of Kosovo, with its registered office at Haki Misini 79, 10000 Mitrovica, Kosova (hereinafter referred to as "Company," "we," "us," or "our").

By accessing or using the PREBETONE website, mobile application, or any related services (collectively, the "Service" or "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Xenoteb sh.p.k regarding your use of the Service.

To use our Service, you must:

• Be at least 18 years of age (or the legal age of majority in your jurisdiction, whichever is higher)
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our Service under applicable laws
• Comply with all applicable local, national, and international laws and regulations

We reserve the right to suspend or terminate accounts that violate these Terms or are suspected of fraudulent activity.

PREBETONE provides the following services:

• Sports Predictions: Expert analysis and predictions for various sports events
• Statistics & Analytics: Historical data, performance metrics, and trend analysis
• Community Features: Social features including following other users, commenting, and sharing predictions
• Live Match Updates: Real-time scores and match information
• Notifications: Alerts for predictions, match results, and community activity
• Premium Services: Enhanced features available through paid subscription

5.1 Free and Premium Services

PREBETONE offers both free and premium (paid) services. Free users have access to basic features, while premium subscribers enjoy additional benefits as described on our pricing page.

5.2 Payment Terms

For premium subscriptions:

• All prices are displayed in the currency indicated at checkout
• Payment is due at the time of subscription or renewal
• Subscriptions automatically renew unless cancelled before the renewal date
• We use secure third-party payment processors to handle transactions

5.3 Refund Policy

We offer a 7-day money-back guarantee for new premium subscriptions. After this period, payments are non-refundable except as required by applicable law. To request a refund, please contact our support team within 7 days of your initial purchase.

5.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to premium features until the end of your current billing period.

When using our Service, you agree NOT to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Post or transmit harmful, threatening, abusive, or defamatory content
• Impersonate any person or entity
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service for any commercial purpose without our written consent
• Distribute spam, chain letters, or unauthorized advertisements
• Upload viruses, malware, or other malicious code
• Interfere with the proper functioning of the Service
• Scrape, crawl, or use automated means to access the Service without permission
• Manipulate or artificially inflate statistics, predictions, or engagement metrics
• Create fake accounts or provide false information

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines without prior notice.

7.1 Our Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are owned by Xenoteb sh.p.k and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The PREBETONE name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Xenoteb sh.p.k. You may not use such marks without our prior written permission.

7.2 User-Generated Content

By posting content on our Platform, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, translate, and distribute such content in any media. You retain ownership of your content but grant us the rights necessary to operate the Service.

You represent that you own or have the necessary rights to post your content and that your content does not violate the rights of any third party.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not guarantee any specific results from using the Service.

Gambling Disclaimer: PREBETONE does not facilitate, promote, or encourage gambling. If you choose to engage in betting activities based on predictions provided by our Service, you do so at your own risk and responsibility. Please gamble responsibly and within your means.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Xenoteb sh.p.k shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
• Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
• We are not responsible for any losses arising from gambling or betting activities, regardless of whether such activities were influenced by our predictions.
• We are not liable for any third-party content, services, or websites linked from our Platform.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Engaging in fraudulent or illegal activities
• Harming other users or the Service
• Upon your request to delete your account

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by using the account deletion feature in your settings or by contacting our support team.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kosovo, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the competent courts of Mitrovica, Kosovo. You agree to submit to the personal jurisdiction of such courts.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

We will notify you of changes by:

• Posting the updated Terms on our website
• Updating the "Last Updated" date at the top of this page
• Sending you an email notification (for registered users)
• Displaying a notice within our Service

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
